RELEASE OF LIABILITY

WAKESPORT WARNING, ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT PLEASE READ CAREFULLY BEFORE ACCEPTING. THIS IS A RELEASE OF LIABILITY & WAIVER OF LEGAL RIGHTS.

1. Definitions. The person who is participating in a wakesport competition or any WWA event shall be referred to hereinafter as “Participant”. The “Accepting Party” means only the Participant when the Participant is age 18 or older OR it means both the Participant and the Participant’s parent or legal guardian when the Participant is under the age of 18. “Released Parties” means: The World Wakeboard Association (WWA), their sponsors, event organizer(s), site owner/lessee or any of their respective successors in interest, affiliated organizations and companies, insurance carriers, agents, employees, representatives, competition officials, assignees, officers, directors, members, and shareholders. The “Activity” means taking part in wakeboarding competition or any WWA event, and using the wakesport facilities or boats for any purpose.

2. Risks of Activity. The Accepting Party agree and understand that taking part in the Activity can be HAZARDOUS AND INVOLVES THE RISK OF PHYSICAL INJURY AND/OR DEATH. The Accepting Party acknowledge that the Activity is inherently dangerous and fully realize the dangers of participating in the Activity. The risks and dangers of the activity include, but are not limited to: actual or alleged transmission of communicable disease such as COVID-19, negligence of Participant, water conditions, water flow, tides, currents, wakes, collisions with other participants, watercraft and other manmade and natural objects, weather conditions, capsizing, sinking, exposure to elements, slips and falls, equipment failure and/or defects, operator error, mental distress from exposure to any of the above, and negligence of others. THE ACCEPTING PARTY ACKNOWLEDGE AND UNDERSTAND THAT THE DESCRIPTION OF THE RISKS LISTED ABOVE IS NOT COMPLETE AND THAT PARTICIPATING IN THE ACTIVITY MAY BE DANGEROUS AND MAY INCLUDE OTHER RISKS. FURTHER PARTICIPANT AGREES THAT PRIOR TO PARTICIPATING, PARTICIPANT WILL INSPECT THE FACILITIES AND EQUIPMENT TO BE USED, INCLUDING PARTICIPANT’S OWN EQUIPMENT, AND IF PARTICIPANT BELIEVES ANYTHING IS UNSAFE WILL IMMEDIATELY ADVISE HIS/HER COACH OR SUPERVISOR AND A COMPETITION OFFICIAL, IN WRITING OF SUCH CONDITION(S) AND REFUSE TO PARTICIPATE.

3. Release, Indemnification, and Assumption of Risk. In consideration of the Participant being permitted to participate in the activity, the Accepting Party agree as follows:

(a) Release. THE ACCEPTING PARTY HEREBY IRREVOCABLY AND UNCONDITIONALLY RELEASE, FOREVER DISCHARGE, AND AGREE NOT TO SUE OR BRING ANY OTHER LEGAL ACTION AGAINST THE RELEASED PARTIES with respect to any and all claims and causes of action of any nature whether currently known or unknown, which the Accepting Party, or any of them, have or which could be asserted on behalf of the Accepting Party in connection with the Participant’s participation in the Activity, including, but not limited to claims of negligence, breach of warranty, and/or breach of contract.

(b) Indemnification. The Accepting Party hereby agree to indemnify, defend and hold harmless the Released Parties from and against any and all liability, cost, expense or damage of any kind or nature whatsoever and from any suits, claims or demands, including legal fees and expenses whether or not in litigation, arising out of, or related to, Participant’s participation in the Activity. Such obligation on the part of the Accepting Party shall survive the period of the Participant’s participation in the Activity.

(c) Assumption of Risk. The Accepting Party agree and understand that there are dangers and risks associated with the participation in the Activity and that INJURIES AND/OR DEATH may result from participating in the Activity, including, but not limited to the acts, omissions, representations, carelessness, and negligence of the Released Parties. By accepting this document, the Accepting Party recognize that property loss, injury and death are all possible while participating in the Activity. RECOGNIZING THE RISKS AND DANGERS, THE ACCEPTING PARTY UNDERSTAND THE NATURE OF THE ACTIVITY AND VOLUNTARILY CHOOSE FOR PARTICIPANT TO PARTICIPATE IN AND EXPRESSLY ASSUME ALL RISKS AND DANGERS OF THE PARTICIPATION IN THE ACTIVITY, WHETHER OR NOT DESCRIBED ABOVE, KNOWN OR UNKNOWN, INHERENT, OR OTHERWISE.

4. Minor Acknowledgment. In the case of a minor Participant, the Accepting Party parent or legal guardian acknowledges that he/she is not only accepting this Agreement on his/her behalf, but that he/she is also accepting on behalf of the minor and that the minor shall be bound by all the terms of this Agreement. Additionally, by accepting this Agreement as the parent or legal guardian of a minor, the parent or legal guardian understands that he/she is also waiving rights on behalf of the minor that the minor otherwise may have. The Accepting Party parent or legal guardian agrees that, but for the foregoing, the minor would not be permitted to participate in the Activity. By accepting this Agreement without a parent or legal guardian’s signature, Participant, under penalty of fraud, represents that he/she is at least 18 years of age. If accepting as the parent or guardian of a minor Participant, accepting adults represent that they are a legal parent or guardian of the minor Participant.

5. Medical Care. Accepting Party authorize the Released Parties and/or their authorized personnel to call for medical care for Participant or to transport Participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed. Accepting Party agree to pay all costs associated with such medical care and related transportation.

6. Miscellaneous. The Accepting Party further agree and understand: (a) Participant will not engage in any activities prohibited by any applicable laws, statutes, regulations and ordinances; (b) this Agreement shall be governed by the laws of the State of Florida and the exclusive jurisdiction and venue for any claim arising out of this Agreement shall be the state courts located in Polk County, Florida and Accepting Party expressly agree and consent to jurisdiction in said courts; (c) Participant grants to WWA, the non-exclusive right to use Participant’s name or likeness in any photographs, television or motion pictures taken of Participant during, training, competition, demos, or other WWA event for the purpose of EVENT promotion; (d) This Agreement constitutes the entire agreement between the parties hereto and supersedes any and all prior contracts, arrangements, communications, or representations, whether oral or written, between the parties relating to the subject matter hereof; and (e) the Accepting Party understand and acknowledge that this Agreement is a contract and shall be binding to the fullest extent permitted by law. If any part of this Agreement is deemed to be unenforceable, the remaining terms shall be an enforceable contract between the parties. It is the intent of the Accepting Party that this agreement shall be binding upon the assignees, subrogors, distributors, heirs, next of kin, executors and personal representatives of the Accepting Party.

I HAVE CAREFULLY READ THE FOREGOING ASSUMPTION OF RISK, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT AND UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM RELEASING LEGAL RIGHTS THAT OTHERWISE MAY EXIST.

MALIBU BOATS WWA RIDER EXPERIENCE NORTH TO BE HELD AT MOUNT HARMON PLANTATION JUNE 19-20

Hosted by Chessie Marine, the third stop of the 2021 Malibu WWA Rider Experience series will hit Earleville, Maryland June 19-20. Amateur riders from across the U.S. are invited to come together for the world’s premier amateur development five-stop series for weekends focused on the next generation in wake through family-friendly instruction and competition.

Kicking off with Shreddin’ Saturday, riders of all skill levels will receive an opportunity to ride, familiarize themselves with the course and receive tips from Malibu’s Pro athletes at Mt. Harmon Plantation. Participants will also have the chance to demo the latest equipment. On Sunday the fun will continue with the WWA Regional Championships and Pro Card Qualifiers, giving amateur riders the chance to compete with riders in their region and qualify for the WWA Wakeboard National Championships and aspiring pros the opportunity to earn professional status.

ENTRY DEADLINES AND FORMAT UPDATES ANNOUNCED FOR 2020 NAUTIQUE WWA WAKE PARK NATIONAL CHAMPIONSHIPS
ORLANDO, FL (July 15, 2020)– In response to the ongoing effects of the COVID-19 pandemic and its widespread impacts across the nation, the World Wake Association (WWA) and Nautique Boat Company have made several modifications to the event format and will be capping entries for the 2020 Nautique WWA Wake Park National Championships. This decision was made to create greater accessibility for interested riders for this year’s event due to the park and water access restrictions in some areas. In addition to the adjustments as an effect of the COVID-19 pandemic and in standing behind the rider’s requests, the WWA has also decided to bring back the LCQ rounds for this year’s event.

In an effort to adhere to local, state and CDC guidelines this event will be capped and filled on a first come, first serve basis. Riders looking to compete at the 2020 Nautique WWA Wake Park National Championships will be able to register and compete individually. Riders that have elected to qualify for Nationals through a Points Chase park qualifier and are competing with a team will get a buy, providing them the opportunity to bypass the first qualifying rounds of competition. Riders who have competed in a Points Chase event this year will also have registration priority ahead of those who haven’t until Wednesday, July 22^nd at 5pm EST. After 5pm EST on July 22^nd the event will be filled on a first come, first serve basis regardless of whether or not the rider competed in a 2020 Points Chase event. This event will hit capacity and riders are encouraged to register by following this link thewwa.com/wakeparknationals.  The entry caps and the cut off dates for this event will be strictly implemented.

In order to support parks that have gotten a late start due to opening restrictions, a new scoring parameter has also been put into place for this year as only the top three scores from each park will be counted for team scoring in each division. Parks are still highly encouraged to bring a larger team, however, please keep in mind only the top three scores will count for this year’s team scoring.

“Adjusting the qualification measures and scoring rules for this year’s National Championships opens up the opportunity for more riders to now compete amidst any issues they’ve had getting on the water due to restrictions or limited access to local events. This year has been unlike anything we’ve seen before and it’s important to the WWA and our partners that everyone is given fair opportunity to participate in these unprecedented times,” commented WWA Executive Director Corrie Wilson. “We so appreciate everyone’s flexibility and patience these last few months and we can’t wait to see everyone at BSR in August! Socially distanced of course!”

All events currently laid out on the event schedule are set to happen as planned and competitors and families will be notified immediately of any event changes. In an effort to continue minimizing the spread of COVID-19 while in consideration for the health and safety of the riders, families, and staff, social distancing guidelines will be implemented at all WWA events. The WWA will ensure these procedures adhere to and operate in compliance with the most recent state and CDC guidelines. Those traveling to the event are also encouraged to take the appropriate steps to preventing COVID-19 while traveling.
